Same-sex marriage conversions for civil partnerships face delays

March 29, 2014  |   Posted by :   |   Blog

Under new same-sex marriage laws which came into effect on the 13th of March, couples are now allowed to make applications to marry in the UK. The first same-sex marriages following the change in law are due to take place on the 29th of March, but for couples currently in civil partnerships who are hoping to organise a conversion to marriage, the wait may be longer. The Government has not provided a clear timescale for when civil partnerships can be converted to marriage, although recent estimated suggest there could be delays in implementing these changes until the end of the year.

Family law experts have warned that the Government could face legal action in the High Court if the appropriate changes are not implemented within a reasonable time frame to ensure equal marriage rights for same-sex couples.

The Government has stated that they are facing complications in the process of backdating benefits and rights associated with marriage to the 55,000 couples in civil partnerships in England and Wales. Those who wish to convert their partnership to marriage are at risk of frustrating delays while these issues are resolved, especially if they are relying on concrete dates with which to plan their wedding.

If you are in a civil partnership and planning to marry your partner once the conversion process is available, please get in touch with Frances Lindsay & Co to discuss your legal needs. We also offer co-habitation, prenuptial and postnuptial agreement services, property and conveyancing, and assistance in writing a will – everything you need as a couple or a family from a trusted and experienced family law team based in the Thames Valley.
