Making a will isn’t the only preparation you need to make to ensure the protection of your family and assets in the future. When you go to draw up a will, it’s also a good idea to assign lasting power of attorney so that your affairs will be looked after in the event that you are unable to make your own decisions, either through injury, illness, old age, or finding yourself canoeing down the Amazon and out of touch…

A lasting power of attorney (LPA) is a legal document drawn up by a solicitor that specifies a trusted individual who can manage your affairs and make sure your wishes are carried out – the main difference is that it can be applied while you are still alive. There are two LPA options available: one which deals with your health and welfare (often referred to as ‘a living will’) and one that deals with property and affairs. You can have one or other or both, it is up to you.

  • A welfare LPA allows your attorney to make welfare and health care decisions on your behalf, if and when you lack the mental capacity to do so yourself. This could also extend, if you wish, to giving or refusing consent to the continuation of life-sustaining treatment.
  • A property and affairs LPA allows your attorney to deal with such things as property, bank accounts, debts, legal issues on your behalf.

You can choose whether person or people to whom you assign lasting power of attorney can act alone or with others and take charge of all your affairs or individual issues Your solicitor will assist you in drawing up an LPA according to your preferences, creating a legally binding document that will provide you with peace of mind for the future.
