Family Mediation Week 18th–22nd January 2021

This week is Family Mediation Week, raising awareness of the benefits of mediation and how it can be used to help couples and families going through separation.

Family mediation is an effective, out-of-court method of working through issues to do with separation in a collaborative and productive way. The aim of mediation is to minimise antagonism, help you really talk to each other, and focus on cooperation, keeping the important decisions in your hands.  It is particularly well suited to those with children and has been shown to offer better outcomes for separating parents than other approaches of dispute resolution.

Supported by a professional mediator, couples are able to work together to find a solution that is in their and their children’s best interests, negotiate financial issues, and figure out living and children’s arrangements, all without needing to go to court. Unlike court-based divorce, mediation appointments can be arranged at a time and date that suits you, and the process is generally much less expensive and time consuming. Mediation can also be used by cohabiting couples, too. And, of course, during the pandemic, all appointments can be conducted via Zoom or FaceTime.

Mediation is not legally binding, however, once your mediator has provided you with a Memorandum of Understanding which details your proposals, your solicitor can prepare an order which, once approved by the court, will make your agreement legally binding. Mediation provides a way for you and your ex to make decisions for your family – both financially and in relation to your children – and can help you to move forward and co-parent amicably after separation.
