Reduction in legal aid has led to increase in DIY divorce as couples attempt to negotiate the terms of their separation as litigants in person (LiP). This has led to concern over a lack of support and 'impossible' court delays due to the difficulty in dealing with the strain of handling their own case. Family law professionals and organisations such as Resolution have spoken out about the difficulty faced by LiPs, and the need for legal aid as well as an option for couples to choose no fault divorce.

According to a recent survey, the average settlement costs of divorce for Londoners is almost double that of the rest of the UK, increasing from approximately £70,000 to £134,500.
The research, which surveyed 2,500 UK adults, shows that these elevated costs are in most part due to expensive living costs rather than higher-value assets. Despite higher house prices and pensions in the capital, London couples are paying more for divorce due to the increased cost of rent and mortgage payments, day-to-day living costs, interest on debts, and higher legal fees.

Following the news that increasing numbers of separating couples are representing themselves, the Government has announced a £2 million ‘support package’ for Litigants in Person (LIPs) to provide practical assistance with dispute resolution. The intention of the new strategy is to encourage couples to seek out-of-court alternatives such as mediation and arbitration, as well as offering support for those who take their case to court. Justice Minister Simon Hughes says that the new Government support package ‘will make sure that separating couples and parents are able to access the right advice, information and support at the right time.’
